Business Name Registration

The Registration of a Business Name in Australia is managed by State Government Registrars on an independent basis. There is no national registration for business names. Accordingly, if you wish to carry on business in every state using the same name, you will have to register in each state and pay the appropriate fee. In many cases it is more economical and efficient to incorporate a company as this provides national registration under Federal Law.

If you only need state registration, because you are only ever going to be a local business, you need to consider the similarity of existing registered names and the availability of the domain name and trademark registration.

As specialist registration consultants we can register a business name for you in any state or territory in Australia. Business names are only registered on a state-wide basis. Applications for Australian business names are processed by the various Offices of Fair Trading and may not be accepted if regarded by the Office as too similar to a previously registered name. Three choices of names are usually available on the application form. Please note: No refunds are available if your application is rejected.
